The Reform of The Judicial Map

Commercial Register of the City Court Bratislava III

You will have registered that from June 1, 2023, the amendments to the laws (150/2022 Coll. and 151/2022 Coll.) came into effect, which bring about a change in connection with the organization of new court seats and court districts, known as the “The Reform of The Judicial Map.”

We would like to draw your attention to the new arrangement of courts within the district of the Regional Court in Bratislava, especially because most of us are based in the mentioned district, i.e. courts originally referred to as District Courts of Bratislava I-V. The first obvious change is that the District Courts of Bratislava have been renamed City Courts of Bratislava, and at the same time only four (4) of the original five (5) courts remain, namely:

• City Court of Bratislava I specializing in Criminal Law agenda;

• City Court of Bratislava II specializing in Family Law agenda;

City Court of Bratislava III specializing in Commercial Law agenda; and

• City Court Bratislava IV specializing in Civil Law agenda.

As it is stated above, the Commercial Law agenda in the district of the Regional Court in Bratislava, is the remit of the City Court of Bratislava III.

To clarify, the City Court of Bratislava III is mainly responsible for commercial law disputes, disputes from bills and checks, disputes from unfair competition proceedings and copyright disputes, disputes from economic competition, disputes regarding arbitration proceedings, disputes from stock exchange transactions and management of the commercial register for the district of the Regional Court in Bratislava.

In the context of this notice, we want to underline the change in the management of the commercial register.

In effect, this means that for persons registered in the commercial register for the district of the Regional Court in Bratislava, the original designation of the registration “Commercial register of the District Court of Bratislava I”, from 01.06.2023 is replaced by the designation “Commercial register of the City Court of Bratislava III”.

With the change in the management of the commercial register, it is therefore necessary to draw attention to the obligations resulting from the change.

In accordance with sec. §3a of the Commercial Code, every entrepreneur is obliged to state on his business documents drawn up in written or electronic form, including on his website (if he has one established)

• business name;

• seat or place of business;

• the legal form of the legal entity;

• identification number, if assigned;

designation of the register that registered the entrepreneur and registration number.

Therefore, do not forget to edit your business documents and information published on your website so that they are up-to-date and in accordance with the valid and effective legislation of the Slovak Republic.

(please note: an analogous change also applies to persons registered in the commercial register for the district of the Regional Court in Kosice)

In conclusion, it should be noted that the violation of the obligation to state on business documents and on websites the specified legal information, in relation to registered persons, results in the imposition of a fine by the registry court, up to the amount of €3,310.00.

Finally, in the event of damage arising from a breach of the stated obligation, a sanction in the form of damages is also considered.
